A Marriage POA is needed when one of the partners, or a legal guardian (like a Wali), cannot be physically present for the marriage registration. It allows the process to continue legally without requiring the Principal’s direct presence at the ceremony.

Q-3. Does a Marriage POA have to be in Arabic?

Yes, the POA must be in Arabic to be accepted by Abu Dhabi courts. If originally drafted in another language, it must be translated into Arabic by a Ministry of Justice-approved legal translator and then officially attested.

Q-4. Is it required to get a Marriage POA officially stamped by a Notary Public?

Yes. The POA must be signed before a Notary Public in Abu Dhabi. If the document is issued abroad, it must be notarized, legalized by the foreign ministry, and attested by the UAE Embassy and Ministry of Foreign Affairs (MOFA).

Q-5. How long is a Marriage POA valid for?

A Marriage POA remains valid until the marriage process is completed or until its specified expiry date. It also becomes void if the Principal revokes it, or in case of the death or mental incapacity of the Principal or Agent.

Q-6. Can non-Muslims use a Marriage POA for a civil wedding in Abu Dhabi?

Yes. Under the UAE Civil Family Law, non-Muslims may use a Marriage POA for civil marriages, provided the document is legally attested, translated (if needed), and explicitly states that it's for a civil marriage.

Q-7. Are there special rules for disabled or elderly people using a Marriage POA?

Yes. The Principal must be mentally capable of understanding the POA's legal effect. Courts may require a medical certificate or psychological evaluation to confirm that the individual is fit to grant such authority, especially in sensitive cases.

Q-8. Can a Marriage POA be used for prenuptial agreements?

No. A standard Marriage POA only covers actions related to the marriage ceremony. If a prenuptial agreement needs to be signed by an Agent, a separate POA explicitly granting that authority is legally required.

Q-9. What are the main risks of using a Marriage POA?

The key risks include potential misuse by the Agent, doubts over the Principal's free consent, or legal disputes if the Principal later changes their mind. Courts carefully review POAs in such cases, especially for vulnerable individuals.

Q-10. How do I cancel a Marriage POA?

To cancel it, you must sign a POA revocation document at the Notary Public. Notify the Agent and concerned individuals officially. Also, inform the relevant marriage registration offices to ensure the cancellation is recorded in their system.
