To obtain a legally valid Power of Attorney (PoA) in Fujairah, both the principal and the agent must meet specific eligibility requirements under UAE law. They are:
1. Legal Capacity of the Principal & Agent
The principal must have full legal capacity at the time of issuing the Power of Attorney.
- Must be at least 21 years old
- Must be of sound mind and mental competence
- Must issue the PoA voluntarily and without coercion
A PoA issued by a person lacking legal capacity can be declared invalid by UAE courts.
2. Valid Identification and Residency Status
To issue a PoA in Fujairah, the principal must provide valid identification documents:
- UAE residents must present:
- Original Emirates ID
- Valid UAE residence visa
- Non-residents or individuals abroad must provide:
- Valid passport
- A PoA attested by the UAE Embassy and the Ministry of Foreign Affairs (MOFA)
4. Clear Purpose and Scope of Authority
The Power of Attorney must clearly state the purpose, scope, and limitations of the agent’s authority.
- General PoAs must define the areas of authority
- Special or Limited PoAs must specify the exact task (e.g., property sale, court representation)
- Property or banking PoAs require explicit powers to be accepted by Fujairah authorities
5. Language and Drafting Requirements
All Powers of Attorney issued in Fujairah must comply with language and drafting rules.
- The PoA must be drafted in Arabic or as a bilingual Arabic–English document
- Any foreign-language PoA must be legally translated into Arabic
6. Notarization by Fujairah Notary Public
For a Power of Attorney to be valid in Fujairah, it must be notarized by a Fujairah Notary Public, or a UAE e-notary service.
